Daniel Hildebrand practices trial and appellate litigation,
with a focus on defending professionals and corporations in securities fraud, class action and professional negligence matters. Dan has also briefed, argued and won numerous contested matters for governmental clients in First Amendment,
constitutional and procurement law. Dan has argued before the United States Court of Appeals for the Seventh Circuit and has briefed matters before the United States Supreme Court, the Illinois Supreme Court and other federal appellate courts. Appellate victories include co-authoring the briefs in
Gariety v. Grant Thornton, a Fourth Circuit decision limiting class action plaintiffs' ability to presume an efficient market; Acorn v. Metropolitan Pier and Exposition Authority, a Seventh Circuit decision affirming that
publicly owned convention and tourism facilities are "non public" forums under the First Amendment; and Argonaut Insurance Co. v. Broadspire, where Dan argued and won a reversal of the district court that preserved the client's
claims for breach of an acquisition agreement. Dan is currently representing Ernst & Young LLP before the Ohio Court of Appeals, 10th District, in an appeal seeking to compel enforcement of an arbitration agreement. He is also currently representing the Metropolitan Pier and Exposition Authority before the U.S. Court of Appeals for the Seventh Circuit in a First Amendment matter concerning public permitting schemes and wrongful arrest claims.
Dan graduated from Yale Law School, where he was Book Reviews Editor for the Yale Law Journal and winner of the William E. Miller Prize. He is also an honors and Phi Beta Kappa graduate of Brown University. After law school he
clerked for Judge Walter J. Cummings on the United States Court of Appeals for the Seventh Circuit.
