Lockley v. CSX Transportation, Inc. (Pennsylvania)

Albert Lockley brought suit against his employer, CSX Transportation, for neck injuries allegedly suffered while working for CSX. We represented CSX in its appeal of the liability judgment and in its appeal of an award of post-judgment interest. With respect to liability, we argued that the trial court erred in denying CSX’s request for discovery regarding Lockley’s condition after his neck surgery and in admitting evidence of allegedly similar injuries suffered by other CSX employees. With respect to post-judgment interest, we argued that the Federal Employers’ Liability Act governed, and prohibited, any such award.
