American Broadcasting Companies, Inc. v. Aereo, Inc. (U.S. Supreme Court)

The Supreme Court granted certiorari to consider the proper construction of the “Transmit Clause” of the Copyright Act as it relates to a company that permits users to watch television programs over the Internet. We represented BSA The Software Alliance in an amicus brief, contending that the Court needed to take care that it did not inadvertently construe the Transmit Clause in a manner inconsistent with the needs of cloud computing. In deciding the case, the Supreme Court expressly noted that its decision should not be read to involve cloud computing questions.
