Adams v. AT&T Mobility, LLC (Ninth Circuit)

The named plaintiffs filed this putative nationwide class action claiming that AT&T violated the federal Telephone Consumer Protection Act by sending text-message advertisements to its wireless customers about upgrading their cellular telephones after AT&T acquired their former wireless provider. We successfully moved on AT&T’s behalf to compel individual arbitration of the disputes, and the plaintiffs appealed, arguing that the arbitration provisions in their wireless-service agreements with their former provider did not apply to AT&T and that enforcing the arbitration agreements would prevent them from enforcing their federal rights.
