American Trucking Associations, Inc. v. New York State Thruway Authority (Second Circuit)
We represent the interstate trucking and bus industries in a class action against the New York State Thruway Authority to recover tolls that the Authority unconstitutionally diverted to fund the state’s canal system—a tourist attraction that does not benefit Thruway users. Although the district court initially held the tolls to be unconstitutional under the dormant Commerce Clause, it subsequently dismissed the case on the ground that Congress had authorized the toll diversion. We are appealing that decision.
