CSX Transportation, Inc. v. Peirce (Fourth Circuit)

Our client, CSX Transportation, sued a group of lawyers and a doctor under RICO and state tort law, alleging that the defendants carried out a scheme to manufacture and file fraudulent FELA claims against the railroad.  Although the district court initially dismissed most of the claims on statute-of-limitations grounds and granted summary judgment for the defendants on the remaining claim, we successfully appealed to the Fourth Circuit and convinced the court to reinstate all of CSX’s claims.

On remand, our client prevailed on all claims and won a $1.3 million jury verdict.  The defendants appealed that verdict, but after briefing and oral argument agreed to pay our client the full judgment amount plus $6 million in attorneys’ fees.
