Dunnet Bay Construction Co. v. Blankenhorn (U.S. Supreme Court)

Petitioner, a construction company, was not awarded a construction contract despite being the low bidder. The case presents the questions (1) whether a plaintiff required to choose between engaging in discrimination on the basis of race or losing a government benefit has suffered an injury in fact sufficient to establish its standing to challenge the adverse state action and (2) whether an equal protection challenge to a state program requiring that a contractor meet subcontracting “goals” for disadvantaged business enterprises (DBEs) may be rejected on the ground that the program complies with applicable federal regulations—without any inquiry whether the State applied its program in a manner that violates equal protection.
