Gordon v. Braxton (Fourth Circuit)

Petitioner is a Virginia inmate who claimed that his trial attorney failed to file a requested appeal on his behalf. We were appointed to represent him before the Fourth Circuit. In a unanimous opinion, the court agreed that the district court did not apply the proper standard of review to our client’s habeas corpus claims and remanded with instructions to consider his claims anew and hold an evidentiary hearing.
