Stitt v. Citibank, N.A. (Ninth Circuit)

Plaintiffs filed a putative nationwide class action against Citibank and CitiMortgage, alleging that defendants improperly charged plaintiffs for inspections of their properties after plaintiffs defaulted on their mortgages. The district court dismissed plaintiffs’ RICO claims, granted summary judgment for defendants on plaintiffs’ fraud and unjust-enrichment claims, denied class certification, and denied plaintiffs’ motion for attorneys’ fees under a catalyst theory.
